Should You File an Extension If Your Prediction Market Records Aren't Ready?

Form 4868 gives you until October 15, 2027 to file a 2026 return, not to pay. How to estimate tax on unfinished Polymarket or Kalshi records and what lateness costs.

Yes. If your Polymarket, Kalshi or Hyperliquid records won't be finished by April 15, 2027, file Form 4868 by that date and pay your best estimate with it. That moves your 2026 filing deadline to October 15, 2027 and removes the failure-to-file penalty, which is by far the larger one. It does not move the payment deadline, so anything unpaid after April 15 still costs interest and possibly a late-payment penalty.

OddsFile is software, not tax advice. The IRS has not issued guidance on how prediction-market contracts are taxed. This article explains the options and the sources behind them; a tax professional can tell you which position fits your situation.

What the extension does

Form 4868 gives 6 more months to file, and you don't need to explain why. The form says plainly that it "doesn't extend the time to pay taxes". The current form is the 2025 version. Check the 2026 version when it is released, because the rules below come from the 2025 text.

The form gives three requirements for a valid request:

  1. Properly estimate your tax using the information available to you.
  2. Enter your total tax liability on line 4.
  3. File by the due date of your return.

Payment with the form is optional, but it's the part that saves money.

The three ways to request it

  • Pay electronically and mark the payment as an extension. The IRS then processes the extension automatically, with no form. Keep the confirmation.
  • E-file Form 4868 through tax software or a preparer.
  • Mail a paper form, with or without payment.

What being late costs

These penalties work very differently. The rates are from the failure-to-file and failure-to-pay pages.

Charge Rate Stops or caps at
Failure to file 5% of unpaid tax per month or part month 25%
Failure to pay 0.5% of unpaid tax per month or part month 25%
Interest 7% a year for Q4 2026, changes quarterly Runs until paid

When both penalties apply in a month, the failure-to-file penalty is reduced by the failure-to-pay amount, giving 4.5% plus 0.5%. For a return required to be filed in 2027 and more than 60 days late, the minimum filing penalty is the lesser of $535 or 100% of the tax.

Worked example

You owe $8,000 beyond withholding for 2026. You file and pay on June 20, 2027, which touches three penalty months after April 15.

No extension Extension, no payment Extension, $8,000 paid April 15
Failure to file $1,080 (13.5%) $0 $0
Failure to pay $120 (1.5%) $120 $0
Interest, about $100 $100 $0
Total, about $1,300 $220 $0

Interest assumes the rate stays at 7% for the 66 days. Filing the form alone saves $1,080, and paying saves the rest.

How to estimate with unfinished records

The form asks you to estimate properly using the information available to you, which is not the same as a finished ledger. A guess with no basis behind it is a weak way to meet that wording, so work through it in this order.

  1. Get a net number per venue. Rebuild what you can from wallet and account history. For on-chain venues, an unreconciled figure is usually available even when the transaction-level file isn't clean.
  2. Pick the costliest treatment you might use. Your choice of treatment is unsettled, and the income to estimate depends on it. Under gambling treatment, tax is figured on gross winnings, which can be far above net profit.
  3. Add the other income on your return. The estimate is total tax, not the tax on trading alone.
  4. Pay the result. Any overpayment comes back when you file.

Step 2 is the reason to overshoot. If you land on a cheaper treatment by October, you get a refund. If you underpay, you pay interest.

The 90% rule

Form 4868 says you're considered to have reasonable cause for late payment during the extension period if both of these are met:

  • At least 90% of your total tax is paid by the regular due date, through withholding, estimated payments or payment with the form.
  • The balance is paid with your return.

So if your final tax is $13,000 and you had paid $12,000 by April 15, that's 92%. No late-payment penalty for the extension period, as long as the $1,000 comes with the return. Interest still runs: about $35 on $1,000 for six months at 7%. Form 4868 says that even with a good reason for paying late, you still owe interest.

What an extension doesn't move

  • Estimated tax. The fourth 2026 payment is due January 15, 2027. An extension has no effect on the underpayment penalty.
  • The §475(f) election. Publication 550 says the election is due by the due date of the prior year's return, without extensions. For 2027, that means April 15, 2027, attached to your 2026 return or to a properly filed extension request. See trader tax status.
  • State deadlines. States set their own extension rules, and some require their own form or payment.
  • Your 2027 tax. Quarterly estimates for 2027 start on their usual schedule while you finish 2026.

Extend or file and amend?

Filing in April on rough numbers and fixing it later is possible, but you sign a return under penalties of perjury, and a known-rough figure is a weak foundation. Filing Form 1040-X adds cost and a second round of work. If you can't support the return yet, extending is cleaner. If you only lack one 1099 and the effect is small, a preparer may reasonably prefer to file.

A faster first step is to measure the gap. Run the free OddsFile check: paste a Polymarket or Hyperliquid address and see your 2026 P&L under each treatment, no signup. Use the highest of those figures as your starting estimate, then see what tax rate you pay to convert it to dollars.

FAQ

I missed October 15, 2026 for my 2025 return. Now what?

File as soon as you can. The failure-to-file penalty is based on unpaid tax, so if you owe nothing there's no penalty to run, and if you owe, each month adds cost. An extension can't be requested after the original due date.

Does an extension raise my audit risk?

The form doesn't indicate that, and we know of no IRS statement linking the two.

Can I change my estimate after filing Form 4868?

Your final return replaces it. You can also make more payments before you file, which stops interest on those amounts.

Do I get an extra six months if I'm a professional gambler or an LLC?

An individual return gets the same extension. A multi-member LLC taxed as a partnership files different forms with its own deadlines. See LLC taxes.
